General Terms and Conditions (B2C GTC) for End Customers of the itemdrop Wardrobe System
1 Scope
1.1 These General Terms and Conditions (GTC) govern the contractual relationship between itemdrop GmbH (hereinafter "itemdrop") and the end customer (hereinafter "Customer") regarding the use of itemdrop's digital wardrobe system.
1.2 By utilizing the wardrobe service (handing over an item and payment), the Customer acknowledges these GTC. The GTC are accessible before the conclusion of the contract via itemdrop.de.
2 Subject of the Contract
2.1 itemdrop is the service provider and contract partner of the Customer. Upon handing over the item and successful payment (cash or non-cash) or scanning the identification medium (QR code/NFC), a custody contract (§§ 688 ff. BGB) is formed between the Customer and itemdrop.
2.2 The service includes the custody of common wardrobe items in a standard manner (e.g., jackets, coats, bags/suitcases as containers). The Customer must ensure that no items of extraordinary value are handed over that exceed the typical expectation of a standard wardrobe. No special custody procedures apply. There is no liability for sweaters, scarves, and other items placed in jackets or coats.
2.3 The processing is done digitally through the itemdrop system. Payment and identification usually occur via electronic payment methods; additionally, the wardrobe fee can be paid in cash if offered on-site.
3 Use of the Wardrobe Service
Process: The Customer hands over the item to the staff and pays via an electronic payment method or – if offered – in cash. In case of non-cash payment, identification is done through tokenization of the payment data (card, wallet, etc.). An alternative identification medium can also be used (e.g., QR code/barcode or NFC card). For pickup, the Customer presents the same payment method or identifier. There is no withdrawal of funds upon pickup. A return is only possible against valid verification.
3.1 Alternative identification in case of token loss: Only with verifiable proof of transaction (e.g., transaction details) and additional security measures. The process must be clearly documented.
3.2 Customer obligations: Use of a valid, functional payment method; ensuring power supply (for mobile methods like wallets) until pickup. No dangerous, illegal, or prohibited items should be handed over. Loss/damage must be reported immediately upon receipt of the item; otherwise, any claims are void.
4 Prices and Payment
4.1 The price is displayed before payment at the terminal and must be paid in euros.
4.2 Payment processing: Directly to itemdrop via the certified payment service provider Viva Payment Services S.A. The GTC of Viva apply additionally (www.vivawallet.com/de_de/terms-and-conditions). If cash payments are offered on-site, the Customer pays the wardrobe fee in cash to the deployed staff; cash revenues are recorded through the itemdrop system and accounted for itemdrop.
5 Liability and Warranty
5.1 itemdrop is liable as custodian according to the law (§§ 688 ff. BGB), including for slight negligence. In case of simple negligence, liability is limited to the typical, foreseeable damage (maximum amount: 200 € per item).
5.2 Disclaimer of liability: For damages caused by force majeure or unforeseeable events. For extraordinary valuable items (e.g., jewelry, electronics, cash in bags) at the Customer's own risk. No liability for loss or transfer of the payment or alternative verification medium.
5.3 Complaint procedure: Report through the complaint tool on the itemdrop website (www.itemdrop.de/beschwerde); itemdrop assumes liability risk and handles complaints. The host can take complaints and forward them to itemdrop. Details of the procedure are available on the website.
5.4 Identity verification upon pickup: The handover of wardrobe items occurs only upon presentation of a valid verification medium. The verification of the Customer's identity by the wardrobe staff is not required and does not take place. Possession of the verification medium (e.g., bank card, NFC card, QR code, or a comparable token) serves as the sole legitimacy for the pickup of the item. By passing the verification medium to third parties, the Customer bears the risk that an unauthorized person may collect the item. itemdrop is not liable for the release of an item to an unauthorized person if they are in possession of a valid verification medium.
6 Data Protection
6.1 itemdrop does not store or process complete payment data. Only pseudonymized transaction information is processed, allowing for secure processing and verification. Processing is done according to the PCI DSS security standards. itemdrop cannot trace back to the cardholder.
6.2 Data security: Encrypted transmission; itemdrop has no access to personal payment data.

7 Right of Withdrawal
7.1 Since the service is a time-bound service, there is no right of withdrawal according to § 312g Abs. 2 No. 9 BGB.
8 Final Provisions
8.1 Amendments: itemdrop may change the GTC; amendments will be communicated on the website.
8.2 Applicable law: German law.
8.3 Jurisdiction: Höxter.
8.4 Severability clause: Invalid provisions will be replaced by valid ones that come closest to the purpose.
8.5 Consumer dispute resolution: itemdrop does not participate in dispute resolution procedures before consumer arbitration boards.
